FICKETT AND SECRETARY OF HOUSING AND URBAN DEVELOPMENT OCCUPANTS OF: 254 Depot Road, (Williamsville) Newfane VT MORTGAGEE'S NOTICE OF FORECLOSURE SALE OF REAL PROPERTY UNDER 12 V.S.A. sec 4952 et seq. In accordance with the Judgment Order and Decree of Foreclosure entered October 27, 2020 in the above captioned action brought to foreclose that certain mortgage given by the late Marian W. Fickett to Wells Fargo Home Mortgage, Inc. , dated April 22, 2002 and recorded in Book 93 Page 409 of the land records of the Town of Newfane, of which mortgage the Plaintiff is the present holder, by virtue of an Assignment of Mortgage from Wells Fargo Bank, N.A., successor by Merger to Wells Fargo Home Mortgage, Incorporated to Nationstar Mortgage LLC D/B/A Champion Mortgage dated October 5, 2017 and recorded in Book 140 Page 15 of the land records of the Town of Newfane for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 254 Depot Road, (Williamsville) Newfane, Vermont on January 19, 2021 at 10:00 AM all and singular the premises described in said mortgage, To wit: Being all the same lands and premises conveyed to Phyllis C. Blocki by warranty deed of Richard D. Kroeger and G. Eugene Kroeger, dated August 25th, 1975 and recorded in Book 44, Page 322 of the Newfane Land Records, and in said deed described as follows; Being a certain farm in the Village of Williamsville, and containing by estimation 8 acres, more or less, with buildings thereon, known as the Pierce Place, and further described as follows: Bounded easterly by lands now or formerly of Nicholas Schultz and by lands of Bernard Johnson; bounded southerly by lands of John Soderberg and Lynnwood L. Warriner; bounded westerly by lands of John H. Williams and the lands of Joseph Rinfret; and bounded northerly by the south branch of the West River; together with all my rights to a certain springs of water on said Soderberg and Warriner property southerly of the highway and now supplying the above premises. Excepting and reserving, however to Central Vermont Public Service Corporation the various pole rights conveyed to it by deed of Charles B. Fisher dated July 12, 1946 and recorded in Book 2 Page 173 of the Newfane Miscellaneous Records. Being all in the same lands and premises conveyed to the said Elaine Fisher Robertson, to her sole and separate use by Warranty Deed of Charles B. Fisher, dated August 2th, 1954, and recorded in book 35 Page 206 of Newfane Land Records. Excepting and reserving from the above description the following described parcel: Beginning at a point on the westerly boundary of the afore described premises, which point lies on the northerly side of the Williamsville Road, so-called, and at the northerly end of a stone wall bordering lands now or formerly of Robert Perry; thence and 14 1/2 East 392.5 feet to a point on the southerly bank of the Rock River, so-called; thence turning and running N 66 1/2 E along the southerly bank of said Rock River a distance of 404.25 feet to a point in the center of a small bridge; thence turning and running S 8 52 1/2 minutes W a distance of 554.87 feet to a point; thence turning and running N 89 11 1/2 minutes W 382.68 feet to the point and place of beginning, said parcel estimated to contain 3.3 acres, more or less. Excepting reserving such rights as may exist for highway purposes over and upon the premises herein conveyed. This conveyance is subject to any and all easements, rights of ay, benefits and encumbrances of record, excepting those otherwise extinguished by the Vermont Marketable Record Title Act, 27 Vermont Statutes Annotated, Chapter 5, Subchapter7. Reference is made to the aforementioned deeds and their records for a further and more particular description of the parcel conveyed. Reference is hereby made to the above instruments and to the records and references contained therein in further aid of this description. Terms of sale: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described. TEN THOUSAND ($10,000.00) Dollars of the purchase price must be paid by a certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid by a certified check, bank treasurer's or cashier's check within sixty (60) days after the date of sale. The mortgagor is entitled to redeem the premises at any time prior to the sale by paying the full amount due under the mortgage, including the costs and expenses of the sale.
