In accordance with the Judgment Order and Decree of Foreclosure entered August 18, 2020 in the above captioned action brought to foreclose that certain mortgage given by the late Barbara A. Buttery to 1st Mariner Bank, dated September 12, 2007 and recorded in Book 364 Page 734 of the land records of the Town of Brattleboro, of which mortgage the Plaintiff is the present holder, by virtue of an Assignment of Mortgage from 1st Mariner Bank to Sun West Mortgage Company, Inc. dated December 8, 2014 and recorded in Book 430 Page 915 of the land records of the Town of Brattleboro for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 7 Union Street, Brattleboro, Vermont on January 20, 2021 at 10:00 AM all and singular the premises described in said mortgage, To wit: A certain piece or land in the Town of Brattleboro in the County of Windham and State of Vermont, described as follows, viz: Being all and the same lands and premises as were conveyed to David A. Wells by warranty deed from Margo Avakian dated September 9, 1986 and recorded in Book 192 at Page 236 of the Brattleboro Land Records and being more particularly described as follows, viz: "Being all and the same lands and premises conveyed to Margo Avakian and F. Randel Hathaway by Warranty Deed of J. Barton Elliott, Jr. and Kathleen M. Elliott dated May 27, 1977 and recorded in Book 151, Page 89 of the Brattleboro Land Records; the interest of the said F. Randel Hathaway having been Quitclaimed to Margo Avakian by deed dated October 25, 1985 and recorded in Book 185, Page 634 of the Brattleboro Land Records, and said premises in both deeds being described as follows: "Being the premises known as No. 2 Union Street and bounded easterly by land of Howard L. Rabideau and wife: bounded southerly by land formerly of Lucy Doolittle; bounded westerly by land formerly of Zigmond J. and Johanna A. Delewski, now of Simon Weinreich; and bounded northerly by the highway known as Union Street, together with the dwelling house standing thereon." The improvements thereon being commonly known as 7 Union Street, Brattleboro, Vermont 05301, f/k/a/ 2 Union Street due to 911 address change. Being the same lot or parcel of ground which by Deed Dated June 24, 1988 and Recorded among the Land Records of Windham County in Book 206 Page 716, was granted and conveyed by David A. Wells, Joined by my Wife, Janet R. Wells, unto Barbara A. Buttery. Reference is hereby made to the above instruments and to the records and references contained therein in further aid of this description. Terms of sale: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described. TEN THOUSAND ($10,000.00) Dollars of the purchase price must be paid by a certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser.
