MONTROLL, AS ADMINISTRATOR OF THE ESTATE OF ARLENE BUZBY OCCUPANTS OF: 317 Canoe Brook Road, Dummerston VT MORTGAGEE'S NOTICE OF FORECLOSURE SALE OF REAL PROPERTY UNDER 12 V.S.A. sec 4952 et seq. In accordance with the Judgment Order and Decree of Foreclosure entered June 30, 2020, in the above captioned action brought to foreclose that certain mortgage given by the late Arlene C. Buzby and the late Howard K. Buzby to Wells Fargo Bank, N.A., dated March 5, 2007 and recorded in Book 95 Page 222 of the land records of the Town of Dummerston, of which mortgage the Plaintiff is the present holder, by virtue of an Assignment of Mortgage from Wells Fargo Bank, N.A. to Nationstar Mortgage, LLC d/b/a Champion Mortgage dated October 5, 2017 and recorded in Book 122 Page 260 of the land records of the Town of Dummerston for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 317 Canoe Brook Road, Dummerston, Vermont on November 20, 2020 at 10:00 AM all and singular the premises described in said mortgage, To wit: Being all of the same lands and premises conveyed to Howard K. Busby and Arlene C. Busby, husband and wife, as tenants by the entirety by Warranty Deed of Clarence E. Harding and Anne T. Harding, husband and wife dated November 8, 1968 and recorded in Bock 4C, Page 514 of the Town of Dummerston Land Records and further described therein as follows: "Beginning at a point on the center line of Greenwood Road, so-called, (Town Road 20) which point is about 1700 feet westerly from the center line of Canoe Brook Road, so-called, (Town Road No. 23) and about 298 feet westerly from the northwesterly corner of land of Lawrence H. Cook and Mary Jane Cook; running thence southwesterly 284 feet along land of the Grantors to an iron pin; running thence northwesterly 315 feet along land of the Grantors to an iron pin; running thence northeasterly 284 feet along lands of the Grantors to the center line of Greenwood Road; running thence easterly along the center line of Greenwood Road 315 feet to the point and place of beginning; containing 1.9 acres, more or less." Being a portion of the lands and premises conveyed to Clarence E. Harding and Anne T. Harding, husband and wife, by deed of Doris D. Zabriskie dated May 4, 1959 and recorded in Book 37, Page 116 of the Dummerston Town Land Records. Reference is hereby had to the above mentioned deeds and the records thereof and to all former deeds and their records for a more particular description of the premises. Reference is hereby made to the above instruments and to the records and references contained therein in further aid of this description. Terms of sale: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described. TEN THOUSAND ($10,000.00) Dollars of the purchase price must be paid by a certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid by a certified check, bank treasurer's or cashier's check within sixty (60) days after the date of sale. The mortgagor is entitled to redeem the premises at any time prior to the sale by paying the full amount due under the mortgage, including the costs and expenses of the sale.
