DEANNA L. NICKEL AND VERMONT DEPARTMENT OF TAXES OCCUPANTS OF: 4914 North Route 100, Wardsboro VT MORTGAGEE'S NOTICE OF FORECLOSURE SALE OF REAL PROPERTY UNDER 12 V.S.A. sec 4952 et seq. In accordance with the Judgment Order and Decree of Foreclosure entered July 31, 2020, in the above captioned action brought to foreclose that certain mortgage given by Deanna L. Nickel to Mortgage Electronic Registration Systems, Inc., as nominee for Countrywide Home Loans, Inc., dated December 30, 2005 and recorded in Book 75 Page 478 of the land records of the Town of Wardsboro, of which mortgage the Plaintiff is the present holder, by virtue of the following assignments of Mortgage: (1) Assignment of Mortgage from Mortgage Electronic Registration Systems, Inc., as nominee for Countrywide Home Loans, Inc. to The Bank of New York Mellon, f/k/a The Bank of New York, as Trustee for CWABS, Inc., Asset-Backed Certificates, Series 2006-3 dated March 19, 2010 and recorded in Book 87 Page 276 and (2) Assignment of Mortgage from The Bank of New York Mellon, f/k/a The Bank of New York, as Trustee for CWABS, Inc., Asset-Backed Certificates, Series 2006-3 to THE BANK OF NEW YORK MELLON, F/K/A The Bank of New York as trustee for registered holders of CWABS, Inc., Asset-Backed Certificates, Series 2006-3 dated September 23, 2019 and recorded in Book 105 Page 22, both of the land records of the Town of Wardsboro for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 4914 North Route 100, Wardsboro, Vermont on October 16, 2020 at 10:00AM all and singular the premises described in said mortgage, To wit: PARCEL 1: Being all the same lands and premises as were conveyed to the Grantors herein by Warranty Deed of Warren S. Patrick and Phyllis H. Patrick dated January 14, 1966 and recorded at Book 24, Page 391 of the Wardsboro Land Records and therein described as follows: Commencing at the point of the north side of Route #100 in the Village of West Wardsboro, Town of Wardsboro, at the southwest corner of the Old School House Foundation; thence running in a westerly direction along the north side of Route # 100 5 rods to a corner; thence running in northerly direction along a stone wall 16 rods to a corner, thence running easterly along a stone wall 5 rods to a corner; thence running in a southerly direction 16 rods to the point and place of beginning with the buildings thereon standing. Excepting and reserving the right to take water from the spring on the above described premises together with a right of entry thereon as more fully set forth in a deed from leon Bills to Alden Torrey dated May 22, 1922 and recorded at Book 19, Page 261. PARCEL 2: Being all and the same lends and premises as were conveyed to the Grantors herein by Quitclaim Deed of Warren S. Patrick and Phyllis H. Patrick dated January 14, 1966 and recorded at Book 24, Page 356 of the Wardsboro Land Records and therein described as follows: It brings the abandoned site of a school house in West Wardsboro Village which was abandoned twenty or more years ago. Beginning at the southeast corner of land on the Northerly side of Route #100 now owned by the Grantors herein; thence northerly 48 feet, more or less, along land of said Grantors to a driven iron pipe; thence easterly 45 feet, more or less, along land now owed by Wales and Beatrice Read to a drive iron pipe; thence southerly 48 feet, more or less, along land now owned by said Reads to a driven iron pipe on the northerly side of said Route; thence westerly along the right of way of said 45 feet, more or less, to the place of beginning. PARCEL ID#: 050010 Being the promises conveyed to the herein named mortgator(s) by deed recorded with Wardsboro Town Office-Land Records in Book 71, Page 402. Reference is hereby made to the above instruments and to the records and references contained therein in further aid of this description. Terms of sale: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described. TEN THOUSAND ($10,000.00) Dollars of the purchase price must be paid by a certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid by a certified check, bank treasurer's or cashier's check within sixty (60) days after the date of sale. The mortgagor is entitled to redeem the premises at any time prior to the sale by paying the full amount due under the mortgage, including the costs and expenses of the sale.
